Boundary Dispute. The boundary was moved without consultation and a new fence line constructed by the adjacent property owner. The detailed evidence of the real boundary made it relatively easy to prove the error. Any layman could read the approved planning application from some 20 plus years prior. The difficulty was in dealing with the obstinacy of the offending party who provided no evidence but continued to be obstructive and used a solicitor that seemed unwilling to read the evidence to an obvious conclusion. Ben Pearson carefully and diplomatically presented information step by step and got agreement on each point.
This led to an agreement to adhere to the joint appointment of a Boundary Surveyor and to adhere to the surveys conclusions. Once the Boundary Survey report had been received the matter was resolved and the fence put back to the original boundary lines.
