We are often instructed by American attorneys on behalf of their clients, and in many cases act, in effect, as local counsel, in the same way that an attorney in New Jersey would work with an attorney in Nebraska. The United Kingdom or Great Britain comprises a number of different jurisdictions - England & Wales, Scotland, Northern Island, and each of the ChannelIslands are separate jurisdictions with their own laws and court systems.

The Spy who must be deposed - Court Orders Christopher Steele to Face Deposition in London. Christopher Steele, a former MI6 officer, wrote what has become known as "the Trump Dossier". The dossier is a collection of reports concerning alleged Russian efforts to influence the United States Presidential election, and possiblelinks between Russia and the then Presidential candidate, and later President, Donald Trump.

Those issues will be determined under the common law rules and, where it applies, the Hague Convention on Choice of Court Agreements (2005). The 2007 Lugano Convention is not included in the transitional provisions in Article 67 of the withdrawal agreement. The 2020 Exit Regulations do not remove the provisions in the 2019 Exit Regulations providing for the application of the 2007 Lugano Convention by the UK on a unilateral basis to transitional cases.For the UK to re-join the Lugano Convention, the consent of all of the existing parties will be required.

A new case on duty of care - John Innes Foundation and Others v. Vertiv Infrastructure Limited [2020] EWHC 19 (TCC). Vertiv, a large infrastructure company, was contracted to provide maintenance for standby and emergency power equipment. The contract had been in place since 2006. The judge set out the relevant test to establish whether there was a duty of care, including foreseeability, proximity, whether it would be fair, just and reasonable, and the type of damage which might be caused - personal injury, physical damage or pureeconomic loss.
