He was instructed to act on my behalf on the assignment of a new lease for my new shop, which was part of a relocation process. I was very eager to move in, as I was faced with a deadline to move out from my existing premises, but was faced with a lackadaisical landlord who seemed most unfazed by time, and solicitors who never seemed to reply to correspondence. I was very concerned that I would not be able to move in on time, and therefore would lose business.
Our fees cover all of the work required to complete the purchase of your new freehold home, including reviewing the title to the property, acting for the lender, if any, dealing with registration at the Land Registry and dealing with the payment of Stamp Duty Land Tax (Stamp Duty) if the property is in England. Disbursements, as referred to below, are costs related to your matter that are payable to third parties, such as Land Registry fees. We handle the payment of the disbursements on your behalf to ensure a smoother process.
The costs of dealing with your "Probate" will vary considerably depending on the complexity of the matter. We charge on the basis of 0.25% of the value of the deceased's estate which comprises "real" property i.e. Again this depends on the complexity of the matter but on average it will take between 6 months and a year from when you instruct us to obtain a grant of Probate. If there is a dispute as the the validity of the will or between beneficiaries or executors it could take considerably longer and this will also add to the costs of our dealing with the administration.
