It is important that you receive advice as soon as you are aware of any potential prosecution. Even if you are intending to admit the driving offence as we can often help to make sure the offences are correct and to mitigate or reduce the penalty, for example helping you to keep your driving licence. If you receive 12 or more points on your driving licence the court will normally disqualify you for a minimum of 6 months but in some cases we can present to the court the hardship this will cause to avoid you being disqualified.
We have experience in representing defendants facing Category 1 and Category 2 extradition. As well as opposing European Arrest Warrants, we have also successfully defeated attempts to extradite clients to Russia and to the USA. Our success lies in our ability to act quickly and to take the initiative in these proceedings. Our experience of negotiating with foreign law enforcement agencies also stands us in good stead when it comes to resolving cross-jurisdictional issues. We have acted for clients across Europe, the US, Russia and the Middle East, as well as on military bases in Germany, Northern Ireland, Cyprus and Afghanistan.
From the historic heart of North Yorkshire, Howard and Byrne has been providing an unparalleled level of service to individuals and companies, since 1999. At Howard & Byrne we have extensive experience and are recognised nationally for our appeal work. In 2018, we were asked by Justice to work together with themselves, King & Spalding, and the Court of Appeal to bring up to date their booklet, How to Appeal. This is distributed, free of charge, to all serving prisoners in England & Wales, and you can download the booklet here.
Fraud, white collar crime, corruption and bribery allegations require specialist advice. We are recognised both national and internationally in this field, appearing in both The Legal 500 and Chambers & Partners. We are also members of the Exchange Chambers' Fraud Forum. We can also assist individuals and corporations, in this country and abroad, who are being investigated under the Bribery Act or similar multi-jurisdictional legislation including Foreign Corrupt Practices Act 1977 (FCPA). We have experience of dealing with prosecuting authorities and investigative agencies both in the UK and abroad.
Whether you are under investigation for an offence or you have been charged and are facing Court Martial, our Military Law team is on hand to provide you with specialist legal advice. All service personnel are entitled to free and independent legal advice whilst at the police station or for interviews with Military Police. Our team regularly represents members of all three armed forces, commissioned and otherwise, at police interviews at civilian and military stations in the UK and abroad. If your matter proceeds beyond the police station and you are informed you are facing criminal proceedings then we have extensive experience at appearing before Courts Martial.
Over recent years there has been a proliferation of Prosecuting Authorities, each with its own areas of responsibility and concern. For individuals and for businesses it can be increasingly difficult to ensure that you are abreast of the regulations which affect you. Regulatory investigations and prosecutions are increasingly common. Howard & Byrne are experts in negotiating with agencies to seek to avoid prosecution and at helping you or your business in mounting a defence. We work together with specialist counsel such as the regulatory team at Exchange Chambers to provide you the highest quality advice.
